In this stage, Gadamer's hermeneutics appears as a dynamic theory enabled to integrate historical and individual situations. Therefore, we shall analyze the distance in time, effectual history and the fusion of horizons that constitutes the setup for comprehension in order to transit from legal dogmatics theory to one of interpretation and juridical application.La teoría de la interpretación jurídica tiene cuestiones pendientes, pues hoy en día se encuentra dominada por el normativismo positivista que reserva cualquier acercamiento del intérprete a esquemas reductivistas que condicionan la práctica judicial en la rigidez de la técnica jurisprudencial. Frente a este asunto, la hermenéutica de Gadamer se posiciona como una teoría dinámica e integradora de las situaciones históricas e individualizadas.
