Ahora, una de las razones que motivaron a la realización de este ensayo fue analizar los principios y fundamentos Constitucionales para llegar a imponer una medida de aseguramiento tan restrictiva, como es la ponderación de derechos fundamentales y la prevalencia de la libertad. Otra de las razones de llevar a cabo el ensayo tiene que ver en la actualidad de estos requisitos y derechos fundamentales que son objeto de protección por parte de los administradores de justicia. Finalmente, la trascendencia de este ensayo, fue conocer qué se ha legislado en materia constitucional, el conjunto de sentencias existentes para la necesidad de imposición de una medida de aseguramiento tan restrictiva. Con ello, se interpretará que la medida de aseguramiento debe cumplir con todos los requisitos constitucionales y legales para su imposición. También es importante señalar que, las personas y entidad de la Fiscalia General de la Nación (Fiscales seccionales de la Unidad de Administración Publica de Buga), son la fuente principal.Especialista en Derecho ConstitucionalEspecializaciónThis essay focuses on carrying out a jurisprudential analysis of the requirements Constitutional Courts to request the imposition of insurance measures deprivation of liberty preventive detention in a prison establishment, For this purpose, the set of existing sentences was investigated in legal matters. on the constitutional requirements for the imposition of measures of security deprivation of liberty, likewise, the norms that regulate the obligation to comply with each of the requirements constitutional provisions, with the above, it was possible to carry out a thorough examination of what prescribed in the Political Constitution of Colombia of 1991 and Law 906 of 2004, standards that regulate requirements for the imposition of security measures security deprivation of liberty (Preventive Detention in establishment of confinement).
