Sumado a ello, de conformidad al marco constitucional, en virtud del art. 42 de la Constitución Política de 1991 el constituyente consagró que es posible crear familia por la voluntad responsable de conformarla, lo que asertivamente abre la puerta al reconocimiento de otros tipos de familia que se han creado como consecuencia de la evolución social. Entre estas, las denominadas familias de crianza, que se crean por lazos de amor, respeto, solidaridad y cuidado mutuo entre sus miembros, que no tienen lazos biológicos o civiles entre sí, las cuales han sido reconocidas por la Corte Constitucional y la Corte Suprema de Justicia desde su jurisprudencia temprana, esto a partir del año 1997, como un medio que ha garantizado el desarrollo integral y satisfacción de derechos de los niños, niñas y adolescentes que son acogidos por personas que sin que medien intereses económicos deciden acogerlos, cuidarlos y propiciar su bienestar, ante el abandono y situación de vulnerabilidad en la que los han dejado sus padres biológicos. Sin embargo, a lo largo de este análisis se detectó una constante preocupante y es la falta de capacitación a los funcionarios encargados de reconocer y garantizar los derechos de las familias de crianza.
