description La tensión que surge entre la política criminal del Estado en cuanto al derecho a sancionar y castigar, por presunta trasgresión o amenaza a la normatividad penal, frente al garantismo constitucional en relación a la protección y garantía de los derechos fundamentales, para nuestro estudio, a la libertad personal y al debido proceso de las personas que aún no son condenadas. La decisión debe estar soportada en los criterios que fija la ley, la jurisprudentecia, de la Corte Constitucional y la doctrina en relación con la imposición de medidas de aseguramiento en centro carcelario por parte de los jueces de control de garantías, sin embargo, hay casos que comparten ciertas características similares y las determinaciones no son uniformes, proporcionales y razonables, por lo que se evidencia que aún persisten incongruencias y contradicciones con respecto a la interpretación, aplicación y justificación de tales preceptos.

In this article would be a description and analysis of the criteria imposed for the law, the constitutional court's jurisprudence and the doctrine related with the imposition of measures of assurances in jail from control of guarantees' judges.
