However, through the implementation of this statutory provision, has generated various controversies expressed in terms of the control in direct contracting by confusion in interpreting acts as head of state or as a presidential candidate, impediments president who aspires to reelection and management of public funds in election campaigns .El presente ensayo tiene por finalidad realizar una interpretación sobre la funcionalidad de la ley estatutaria de garantías electorales expedida en el año 2005, la cual, surgió como necesidad de igualdad en el establecimiento de condiciones en periodos de elección presidencial, en el evento que el presidente de la república pretenda ser nuevamente elegido por un segundo periodo consecutivo o en su defecto el vicepresidente en el caso que el presidente no aspire a la reelección y aquel se postule. Sin embargo en la ley 996 de 2005 se fijan parámetros legales de aplicabilidad entre otros los topes para las campañas políticas, medios de comunicación, prohibición para la suscripción de convenios interadministrativos, manejo de nómina y de contratación, durante los cuatro meses anteriores a las elecciones presidenciales y hasta la realización de la segunda vuelta, si a ello hubiera lugar, lo cual se fundamenta en la búsqueda de la equilibrio de poderes, la promoción de la competencia. En esta medida, su propósito es que esta regulación se convierta en una normativa útil y eficiente.
