Enshriningtworebates forthe start of thepreliminary hearingandtrial.TheSupreme Courtand the Constitutional Courtdeclaredenforceablestandard, whereas thedecrease of aquarter ofpunitivebenefitwas extended toallprocedural opportunitieswherecaught in flagrancymayacquiesceto fees andsign agreements withtheAttorney General'sNation.La aplicabilidad del parágrafo del art. 301 del C.P.P. modificado por el art. 57 de la ley 1453 del 2011, que rebaja en un cuarto el beneficio cuando la captura se produjo en estado de flagrancia, quebrantó los principios de justicia premial, derechos de igualdad, el debido proceso, la seguridad jurídica de los imputados, violando las garantías por falta de unidad de criterios, al no definir el precepto normativo que favorece al delincuente que se allanó en etapas posteriores a la audiencia de imputación, por lo que debió el legislador adoptar la misma rebaja para todos los momentos procesales, modificando los arts. 356 numeral 5 y 367 Inc. 2 que consagran rebajas para la audiencia preparatoria e inicio del juicio oral.
