Responsabilidad del estado por actos terroristas: título de imputación, daño especial

El análisis en la atribución de responsabilidad patrimonial del Estado por los actos terroristas perpetrados por terceros, en el correspondiente artículo, busca los fundamentos de responsabilidad del Estado diferenciando los títulos de imputación jurídica aplicados por el Consejo de Estado para fallar los casos de actos terroristas: falla probada del servicio, riesgo excepcional y daño especial. Las contradicciones planteadas en la aplicación de éstos regímenes, ha generado cierta confusión en los fallos del Consejo de Estado, teniendo en cuenta que es la máxima corporación de lo contencioso administrativo.
