description Este artículo permite establecer si el derecho de petición, cumple con los lineamientos conforme a su real naturaleza para ser categorizado como derecho fundamental, realizándose un recorrido histórico por las anteriores Constituciones Políticas de Colombia, análisis jurisprudencial y estudio de derecho constitucional comparado, utilizando investigación descriptiva, diseño de investigación bibliográfica y realizando un análisis hermenéutico que permite la consecución de elementos que indican, que este derecho no cumple con los requisitos establecidos por la Corte Constitucional y por lineamientos internacionales para catalogarlo como derecho de primera generación, concluyendo que conforme a sus componentes actuales y características, es viable posicionarlo entre los derechos de segunda generación, lo que posibilita predicar, que no debería gozar de los efectos de los derechos fundamentales en cuanto a su protección.
