Con este artículo se pretende enterar a la comunidad en general en qué consiste el delito de inasistencia alimentaria, su evolución histórica, su alcance normativo y disposiciones que le permiten a quien tiene derecho de recibir alimentos, reclamarlos por la vía penal, cuando la jurisdicción civil no es suficiente para hacerlo. Igualmente se determinará la efectividad de la norma penal de cara a la problemática social generada por la falta de asistencia alimentaria de quienes tienen la obligación de suplirla, concretamente con la entrada en vigencia de la Ley 1542 del 5 de julio del 2012, por la cual se reforma el artículo 74 de la Ley 906 de 2004, que eliminó el carácter de querellables y desistibles de los delitos de violencia intrafamiliar e inasistencia alimentaria. |
