En consecuencia, tras el examen de diferentes fuentes dentro del marco penal, se concluye, entre otras aristas que, el principio de Congruencia constituye un elemento sustancial del debido proceso porque hace parte de la estructura de este y se enmarca como un eficaz instrumento para el ejercicio del derecho de defensa.
