The first part examines the concept of justice from the criticism that Kelsen makes to the way from the philosophy has established the values as the founding principles of justice and law, and the second one, it is discussed the new concept of law that Kelsen proposed from a purifying perspective in which the “scientific reason” has a priority position over values and moral constraints.El propósito de este artículo es analizar la posición de Hans Kelsen con respecto a la noción de justicia y su relación con valores tan importantes como la felicidad, la igualdad y la justicia. En la primera parte se estudia el concepto de justicia desde la crítica que Kelsen hace a la forma en que desde la filosofía estos valores se han presentado como principios fundadores de justicia y de derecho.
