RESUMEN: La concepción jurídica que se ha tenido de los animales en los distintos ordenamientos jurídicos a nivel global, ha venido fluctuando en las últimas décadas, no siendo Colombia la excepción a dicha circunstancia, sin embargo, a pesar de los valiosos avances a nivel jurisprudencial y legal en la materia, aún sigue en vilo el discernimiento respecto a la calidad jurídica que se les imputa, en tanto, a pesar de ser considerados como seres sintientes desde la reciente Ley 1774 de 2016 y gozar de una serie de principios constitucionales y legales respecto a su bienestar integral, hoy por hoy, ante la duda de su situación jurídica, se continúan desconociendo sustancialmente dichas prerrogativas otorgadas a los animales, haciendo prevalecer las formalidades frente a la justicia material; tal como podrá verse en el caso del oso de anteojos Chucho, con la exposición de la Sentencia de la Corte Constitucional SU 016 de 2020, para que, de esta forma, se concluya cómo podemos comprender desde la jurisprudencia y la Ley colombiana la principialistica en torno a la protección animal y la concreción de sus derechos. |
