RESUMEN: El presente artículo recopila y describe los riesgos que presenta el uso de los Criptoactivos, para evidenciar cómo se vinculan con los prototipos normativos que se han propuesto desde diferentes autoridades y finalizar con la exposición del estado normativo de los Criptoactivos en Colombia. Por lo tanto, el texto se divide en cuatro partes: en la primera se define, en términos generales, la naturaleza de los Criptoactivos para relacionarlos con el Blockchain como tecnología subyacente; en la segunda se caracterizan los riesgos generados por el uso de los Criptoactivos, los cuales se identificaron mediante el proceso investigativo que soporta este artículo; en la tercera se hace un esbozo del tratamiento regulatorio extranjero y nacional para mitigar dichos riesgos; en la última se presentan las conclusiones. |
