RESUMEN: El presente artículo tiene por objeto abordar el testimonio con fines judiciales como prueba extraprocesal del Código General del Proceso para identificar la utilidad práctica de esta herramienta en las labores investigativas desarrolladas por la defensa dentro del proceso penal. para ello se analizó la figura de la prueba extra proceso, su relación con el derecho a la prueba y sus posibles usos en la investigación independiente que realiza la defensa en virtud del principio de igualdad de armas. Se concluyó que el testimonio con fines judiciales como prueba extraprocesal tiene utilidad práctica para: 1) Preconstituir prueba; 2) Asegurar la prueba; 3) Fortalecer la teoría del caso; y 4) Adelantar labores investigativas y de corroboración de los hechos que serán objeto del litigio. Y su utilidad procesal se enmarca principalmente en: 1) Servir como medio de control para el interrogatorio cruzado de testigos; y 2) Asegurar la declaración como prueba. |

To this end, the figure of extrajudicial evidence was analyzed, its relationship with the right to evidence, and its possible uses in the independent investigation carried out by the defense under the principle of equality of arms. It was concluded that testimony for judicial purposes as extrajudicial evidence has practical utility for: 1) Preconstituting evidence; 2) Securing evidence; 3) Strengthening the theory of the case; and 4) Carrying out investigative tasks and corroborating the facts that will be the subject of the litigation.
