Este análisis se encamina a sentar las bases argumentales respecto de la pertinencia que tiene incorporar la distinción «permisos fuertes»«permisos débiles» de la teoría general del derecho a la doctrina del injusto penal, concretamente en el tratamiento conceptual de algunos supuestos de exención de responsabilidad que son concebidos por parte de la dogmática penal germanista como situaciones de necesidad exculpantes y que podrían ser consideradas, en tanto permisos (débiles), como “causas” de justificación. |
