RESUMEN: El texto que se presenta se propone por objetivo analizar la valoración de la prueba digital en el proceso civil, tomando como contexto el ejercicio del derecho procesal en Colombia y la implementación de la justicia virtual como innovación a en actuación judicial a partir de la aplicación de la Ley 2213 de 2022. Se busca determinar mediante una revisión documental el valor jurídico de la prueba virtual, entendiendo en este concepto la idea de legitimidad del material probatorio situado en escenario informáticos que son objeto de revisión por parte del juez. Para ello se hace necesario implementar una metodología de análisis documental que implica un desarrollo hermenéutico basado en la interpretación de datos. El punto de referencia para el desarrollo es la Constitución Política de Colombia (1991), ya que esta se constituye en norma de normas en toda interpretación de tipo jurídico. Como conclusión central de este análisis se llega a que la prueba digital es legítima y se encuentra regulada por el Código General del Proceso en Colombia. |

The aim is to determine through a documentary review the legal value of virtual evidence, understanding in this concept the idea of legitimacy of the evidentiary material located in computer scenarios that are subject to review by the judge. To do this, it is necessary to implement a documentary analysis methodology that involves a hermeneutical development based on the interpretation of data. The reference point for development is the Political Constitution of Colombia (1991), since this constitutes a norm of norms in any legal interpretation.
