RESUMEN: Este artículo de investigación tiene por objeto analizar el pago de incapacidades por enfermedad común en el sistema de seguridad social en salud desde el derecho fundamental al mínimo vital. Para lo cual, presenta una descripción sobre el sistema de seguridad social de salud en Colombia, haciendo énfasis en la financiación del régimen contributivo; un análisis de la normativa atinente a la incapacidad por enfermedad general; una determinación de los componentes del derecho fundamental a la Salud y su relación con el pago de incapacidades por enfermedad general y una conceptualización del derecho fundamental al mínimo vital. Así, a partir del análisis de datos y las fuentes documentales, fue posible concluir que si bien las incapacidades por enfermedad común fueron en un principio un auxilio a cargo del empleador, a partir de la Ley 100 de 1993 se vuelve una prestación económica del sistema general de salud, y que si lo que busca es proteger al trabajador que soporta una enfermedad para la recuperación de su salud, las normas aplicables al pago de incapacidades por enfermedad general vulneran el derecho fundamental al mínimo vital de un trabajador, al reducir sustancialmente su salario y capacidad de subsistencia en condiciones dignas. |

For this, it presents a description of the social health insurance system in Colombia, with emphasis on the financing of the contributory system; an analysis of the regulations concerning incapacity for general illness; a determination of the components of the fundamental right to health and its relation to the payment of incapacities for general illness and a conceptualization of the fundamental right to the vital minimum.
