Este medio de prueba en materia procesal civil se encuentra regulado por la ley 1564 de 2012 y actualmente su práctica se desarrolla en los términos establecidos por esta ley y la ley 2213 de 2022. En ese sentido, se abordará el tratamiento de la prueba testimonial en materia civil, de acuerdo con lo establecido en el Código General del Proceso y la incidencia de la ley 2213 de 2022 en el proceso de producción del medio de prueba. A partir de lo cual se concluye, que la práctica presencial de la prueba testimonial se aplicará en dos situaciones excepcionales; en primer lugar, cuando el despacho o las partes no cuenten con los medios tecnológicos para acceder de forma virtual, y, en segundo lugar, cuando el juez lo determine, por razones justificadas de seguridad, inmediatez y fidelidad. |

This evidence in civil procedural matters is regulated by Law 1564 of 2012 and currently its practice is developed under the terms established by this law and Law 2213 of 2022. Therefore, the treatment of testimonial evidence in civil matters will be addressed, in accordance with the provisions of the General Procedural Code and the practical incidence of Law 2213 of 2022 in the test medium production process.
