RESUMEN: El propósito de este artículo sobre el anuncio del proyecto es analizar la viabilidad de la inscripción del instrumento de gestión en el folio de matrícula inmobiliaria de los bienes inmuebles que se ven afectados por esta figura. Por ello, se realizará una revisión de este instrumento de cara a los negocios jurídicos sujetos a registro, de manera general de los bienes inmuebles realizando una interpretación de la normatividad que rige en materia del anuncio, y de inscripción de gravámenes a la propiedad permitiendo identificar la viabilidad de la inscripción o no de éste. Se revisan diferentes fuentes bibliográficas, destacando el Decreto 2729 de 2012. Se concluye que el instrumento de gestión debe estar inscrito en el folio de matrícula inmobiliaria, con el ánimo de que privados que pretendan realizar contratos que puedan afectar el valor comercial sobre estos inmuebles, tengan la seguridad jurídica de conocer la realidad, dado que, en cualquier momento el Estado puede hacer efectiva la expropiación judicial o administrativa, tras de eso, el precio del valor comercial se congela en el mercado. |
