RESUMEN: Este artículo presenta un análisis sobre las barreras y retos a que están enfrentados los pacientes del sistema de salud de Colombia, la región y el mundo, al tratar de acceder al derecho fundamental de salud, concretamente al procedimiento de eutanasia en pacientes que padecen enfermedad terminal o irreversible y que los diferentes procedimientos y tratamientos que requieren para aliviar su sufrimiento intenso y permanente, son insuficientes para garantizar la dignidad humana, la paz y la tranquilidad y el respeto a sus valores, y en uso, de la autonomía y control, evitar esa carga a sus familias, reduciendo costos económicos y emocionales; Son notables las falencias existentes en Entidades Promotoras de Salud y los sistemas legislativos de los diferentes países al tratar de garantizar este derecho. En América Latina, Colombia es uno de los países que en la actualidad cuenta con una legislación progresista en este tema, pero es evidente que todavía existen brechas que dificultan y en ocasiones imposibilitan el acceso a este derecho fundamental. Resulta entonces importante abrir puertas al debate sobre el tema para alcanzar unas conclusiones que vislumbren la situación ante la comunidad en general, el Estado y las instituciones encargadas de la prestación del derecho, para que se respeten y apliquen de manera correcta, las disposiciones normativas existentes en materia de Derechos Humanos y demás garantías que están siendo vulneradas a esta población, en el marco del derecho a la muerte digna y evitar de este modo la prolongación del sufrimiento. |

In Latin America, Colombia is one of the countries that currently has progressive legislation on this issue, but it is clear that there are still gaps that hinder and sometimes make it impossible to access this fundamental right.
