RESUMEN: El poder punitivo manifestado especialmente en la existencia y el uso de las prisiones, pero expresión también del castigo en general (en la relación consigo misma y las demás personas, en la familia, la escuela, las empresas, etc.), se encuentra en una íntima relación con el patriarcado: surge de él y para él. Al ser analizado minuciosamente revela también muchas características propias del sistema de opresión patriarcal, el cual es universal y se encuentra en toda la historia conocida de la humanidad. La prisión como eje simbólico, así como todo el complejo entramado de lo que denominamos justicia penal, se entienden mejor en relación con los elementos que conforman el patriarcado, así mismo, este último se puede comprender más a fondo analizando la lógica del castigo. Estos son los temas que se tratan en este texto, que buscan integrar las visiones que ofrecen el abolicionismo y el feminismo, las cuales concluyen que es necesario un cambio cultural general, civilizatorio. En ese sentido, el artículo expone, luego de una breve introducción, por qué el poder punitivo es un poder patriarcal, posteriormente se profundiza en tal tesis a partir de la exposición de seis rasgos comunes: 1) el desprecio por la vida, 2) la generación de siervas (víctimas, incapaces, infantilizadas), 3) la utilización amañada de las ciencias, 4) el interés en la ruptura de los lazos de solidaridad, 5) el fundamento en la lógica dualista y 6) la relación entre el concepto "culpa de la punición" y el concepto "eres mía" del patriarcado. Finalmente se esbozan algunas conclusiones, en las que se recalca la necesidad de un cambio cultural que renuncie al castigo, eliminando también el patriarcado y, se llama a las mujeres a jalonar tales transformaciones, no sin antes lanzar algunas ideas para avanzar en ese camino. |

When analyzed in detail, it reveals many characteristics of the system of patriarchal oppression, which is universal and is found throughout the known history of humanity. The prison as symbolic axis, as well as the complex that is called penal justice, is better understood in relation to the elements that make up the patriarchy, which can also be better understood by analyzing the logic of punishment. These issues are treated in this text, which seeks to integrate the visions offered by abolitionism and feminism, which lead to the conclusion that a general cultural, civilizing change is needed. In this regard, the article analyzes, after a brief introduction, why punitive power is a patriarchal power, and then furthers the analysis with a look at six traits these powers share: 1) the disregard for life, 2) the generation of servants (victims, incapable, infantilized), 3) the fraudulent use of science, 4) the interest in breaking the bonds of solidarity, 5) the basis in dualistic logic and 6) the relationship between the concept of "guilt of punishment" and the "you are mine" of the patriarchy.
