RESUMEN: Este artículo aborda un tema controversial en Colombia; la gestación subrogada, toda vez que es una práctica recurrente en el país y existe regulación limitada al respecto. Frente a ello, la Corte Constitucional en sentencia T-968 de 2009, legitima esta modalidad como alternativa para resolver los problemas de parejas infértiles. Así mismo, reconoce la informalidad de esta, visibilizando la facilidad con la que se pueden encontrar en diferentes plataformas de internet, anuncios de mujeres de todas las edades, ofreciendo su vientre con la finalidad de que otras personas se conviertan en padres. Es por ello, que, a través del estudio de un caso real, se determinarán los obstáculos a los que se enfrentan quienes se encuentran involucrados en procesos de gestación subrogada, las garantías que hay en Colombia para la protección de sus derechos y las diferentes respuestas jurídicas a los vacíos normativos existentes. Por último, se presentará una propuesta orientada desde el legal design, con el objetivo de que las personas que no posean conocimiento al respecto pero que por diversas razones están interesadas en el tema, puedan instruirse y así buscar que el desconocimiento no sea utilizado como justificación para transgredir los derechos de otros. |

In view of this, the Constitutional Court in sentence T-968 of 2009, legitimizes this modality as an alternative to solve the problems of infertile couples. It also recognizes the informality of the same, making visible the ease with which you can find on different internet platforms, advertisements of women of all ages, offering their wombs in order that others become parents. That is why, through the study of a real case, the obstacles faced by those involved in surrogacy processes will be determined, the guarantees that exist in Colombia for the protection of their rights and the different legal responses to the existing regulatory gaps.
