RESUMEN: Con la Revolución Industrial de finales del siglo XVIII se rompen las estructuras socioeconómicas que existían hasta ese momento tanto a nivel mundial como en Colombia, es así como surgen nuevos sectores económicos, nuevos actores (como comerciantes y empresarios) y a su vez la necesidad de hacer inversiones muy grandes de las cuales sólo se podrían generar retornos económicos en periodos posteriores, es en ese escenario que se crea el mercado financiero y posteriormente el mercado de valores con el fin de inyectar capital y financiar los proyectos de las nuevas industrias. Con una nueva realidad económica también se debieron crear nuevas herramientas contractuales para regular las relaciones entre los actores del mercado bursátil, es así como desde el nacimiento de este y hasta la actualidad se ha ido construyendo y fortaleciendo no sólo un contrato sino un sistema de regulación que brinde las herramientas necesarias para un método de negociación tan diferente al acostumbrado. |

New economic sectors and actors (such as traders and capitalists) emerge and with them the need for long term investments. In this context, the financial and stock market were created in order to inject capital and to finance the new industries. A new economic structure meant new legal tools in order to regulate the relationship between the players in the stock market.
