Summary:The San Pablo property, located in the Bajo Sinú Marsh Complex – CCBS in the jurisdiction of the municipality of Cotorra, is perhaps one of the most emblematic cases of the CCBS when it comes to portraying the position of the State in the face of the tensions generated by the land against areas that, despite being considered assets for public use, have been subject to appropriation by private individuals. Therefore, it was proposed to analyze the legal situation of the San Pablo property from the perspective of ownership. The methodological approach used was the case study, through the review of the administrative acts issued by the land authority, the review of the regulations that regulate the treatment of these assets and in turn through field work within the communities that make up São Paulo. The results showed the presence of limitations in access to land ownership by peasant communities whose access has been limited, in contrast to the monopolization of sectors with influence in the region. It is concluded that an imbalance and denaturation of goods for public use have been generated, particularly in national vacant lots, as in the case of the CCBS.
