The work itself is a proposed system of law in general, which proposes a global taxonomy with in which the penalty factor is part of public law. From there it operates the subjective bases of criminal law, that is, one whose foundations reveal the guilt as a basis of liability.

Sin embargo, de ello no se deduce que, con fundamento en la teoría de sistemas, haya existido siempre una estructura penal sistémica que dé cuenta de la función punitiva del Estado. Pese a las incursiones discursivas que la historia devela, como la obra de Beccaría, quien primeramente formula una sistematización jurídica que incluye el discurso apropiado para ello del derecho penal, fue precisamente Kant, en Metafísica de las costumbres. La obra como tal es una propuesta sistémica del derecho en general, en que propone una taxonomía global dentro de la que el penal hace parte determinante del derecho público. A partir de ahí, opera las bases del derecho penal subjetivo, esto es, aquel cuyos fundamentos develan la culpabilidad como fundamento de la responsabilidad.application/pdfMoya-Vargas, M. (2010).
