Summary: | The minor as a responsible and imputable subject under Colombian law, is under a special jurisdiction, the Criminal Responsibility System for Adolescents (SRPA), which governs or intervenes in the investigation and prosecution of crimes committed by people who are between fourteen (14) and eighteen (18) years old at the time of committing a punishable act. The purpose of this article is to carry out a critical reflective analysis with respect, to the Sistema de responsabilidad Penal para Adolescentes (SRPA), specifically regarding the intervention programs proposed by the Instituto Colombiano de Bienestar Familiar (ICBF), and how these interventions and their way of implementing them, can become both a risk factor and a protective factor against criminal recidivism and the re-entry of minors into the SRPA. In conclusion, a reflection is made regarding the importance of reviewing both the guidelines and their compliance; which we consider should be associated and directed towards a timely and specialized intervention of risk factors individually, since they are the ones that ultimately contribute greatly, to the increase or decrease in the probability that young people and adolescents take the decision to initiate, maintain and repeat the criminal life. |
