Summary:The purpose of this paper is to analyze, in accordance with current legal regulations and jurisprudence, under what conditions the strikes of air traffic controllers and commercial airline pilots could be appropriate, as well as the possible impact of the essential public service of air transport in Colombia. In the first part, a historical study is carried out on the evolution of the right to strike in the Colombian legal system and on the way in which the legislator has been establishing, since the forties of the 20th century, the nature and classification of the essential public services. In the second part, an account is given of the main instruments of international law that regulate the right to strike. Finally, in the last part an analysis is made of the difficulties that from the legal point of view has the definition of essential public services and, therefore, on the need for the legislator to promulgate norms that define them clearly
