Democracia, deliberación y derecho de acceso a la información pública en América Latina Particularmente en Colombia

This paper describes the relationships between democracy, deliberation and the right of access to public information in the Latin American context. To begin with, it’s been analyzed how citizens' access to public information (which is guaranteed by the State) directly affects the quality of deliberation and allows democratic decisions to be more legitimate. Similarly, it’s laid out how the right of access to information is developed in some Latin American countries, as well as the barriers which in practice limit their effective enjoyment and the challenges that states must face to make public information more accessible. It's exposed what has been the legislative development in Colombia, regarding the right of access to public information and the effectiveness of the protection mechanisms for this fundamental right; Since eventually, it has been the Colombian Constitutional Court that has allowed this right to be guaranteed when it collides with other equally fundamental ones. At last, it’s stated that it’s not always due to the public administration and the possible deficiency in its tools, that the right of access to information does not materialize, because sometimes the citizen assumes a position of disinterest against this, as an example, ignoring how influential is the knowledge of their social reality at the time of exercising their right to vote. The aforementioned, added to the challenges democracy faces today in a globalized world.
