| Summary: | Considering the need addressed by the Colombian society the evolution of the concept of family, both judicial bodies as the legislature have timidly attempts to address so that the existing parity between the development of the family as the core of society and establishing the rights of the gay community that demands respect for self determination and the adequacy of legal space that allows them the enforceability thereof, is not affected by the cemented by religious morality and social ethics prejudices . This article shows the confrontation of the moral, sociological and legal theories and determine the causes that have led to stagnation in Colombia to adopt a legal system that takes effective rights of the gay community and at the same time allowing the promotion a positive image of the country as a guarantor of human rights state. |
