Description
Summary:The main purpose of this paper focuses on establishing the civil responsibility that can be derived from the practice of cosmetic surgery in children under 18 years through a doctrinal, legal and jurisprudential analysis, from different perspectives, namely: the responsibility of the medical professional , the responsibility of the persons granting the authorization (parents) and the joint and several liability of the medical centers that facilitate the facilities for performing the surgical procedure. For this, a qualitative study is carried out through which legal implications and conceptualizations are analyzed on a topic that causes great controversy in Colombian society and that, in one way or another, polarizes the opinions of legislators, public figures, officials , medical community, among others; more than enough reasons, since the aesthetic medical activity without urgent need or by vanity of some minors that taking advantage of the little time of the parents or guardians who admit or authorize the performance of surgeries that often do not achieve the final objective, can generate consequences that are often irreparable, such as death or permanent physical injuries, which can lead to controversies that require a clear response from the Colombian legal system
