Now drugs are a topic of global debate, the problem has spread to many countries and the question of how to address this situation has become more evident. Analyze other legal systems more tolerant of marihuana use, is relevant to the extent that we can provide a different vision to what is happening now in Colombian system, therefore analyze systems such as Holland and Uruguay which tend the legalization of marihuana. Similarly, the central point the present article is to demonstrate unknown incidence of the legislative act 002 of 2009 in Colombia, which performs a fundamental change little considered, as currently the Constitution mandates the protection of who not find another way out different, than the use of psychoactive substances.
