Las organizaciones delictivas han utilizado el sistema financiero1 para consumar varios hechos que constituyen atentados contra bienes jurídicos protegidos por el derecho penal. Quizás, dentro de estos bienes uno de los más relevantes sea el del orden económico y social, pues dada la magnitud de los comportamientos llega a afectarse la esencia misma de la sociedad. No podemos negar que la economía es base de cualquier sistema social y por lo tanto depende de su organización. Es así como, desde hace muchos años y ante la zozobra que causan los comportamientos antijurídicos en el sistema financiero, se ha pretendido recobrar la confianza en el sector a través de normas de carácter penal, que tratan de solucionar la crisis que se viene presentando desde hace mucho tiempo. |
