Para el efecto, en primera lugar, se analizaron las formas de responsabilidad que tiene el Estado; en segundo lugar, se revisaron los fallos del Honorable Consejo de Estado sobre la aplicación del juicio autónomo del dolo civil en materia de privación injusta de la libertad, se establecieron diferencias entre la responsabilidad penal y civil, para, finalmente, enunciar en qué tipos de casos es aplicable el juicio autónomo del dolo civil, según la información encontrada en la jurisprudencia.
