El defecto material o sustantivo, conforme a la entidad de cierre en la jurisdicción constitucional, tiene aplicación cuando de la autoridad judicial emana, dentro de su interpretación errática, la ejecución de una norma, que, en forma diáfana, es inaplicable, se deja de aplicar en el deber ser, y/o contradiga en su disquisición, los supuestos mínimos de la razonabilidad jurídica, lo que implica, la susceptibilidad del mecanismo normativo de la tutela por burda violación al debido proceso. Nuestro trabajo de investigación, describe los supuestos donde se puede configurar ese defecto, además de estudiar en forma teórica los límites de los jueces para aplicar la ley y la aproximación de elaboración de una línea jurisprudencial de la prevalencia del derecho sustancial sobre las formas. |
