La función pública contractual es sin duda una de las actividades de mayor complejidad y trascendencia dentro de la dinámica de la Administración, por cuanto es a través de esta que el Estado cumple con sus fines esenciales y con la prestación de los servicios públicos que tiene a cargo. En el marco normativo que rige esta materia, se establece el tipo de personas que pueden contratar con el estado, encontrándose entre ellas los Consorcios. Si bien la normatividad contractual en Colombia es exuberante, resulta paradójico que esta no haya previsto situaciones, que, si bien parecieran extraordinarias, las mismas ya hacen parte de la dinámica en la ejecución de los contratos, entre la cuales se encuentra la figura de la suspensión. Ante la falta de reglamentación, es la jurisprudencia quien desarrolla esta situación, estableciendo las circunstancias que amparan tal eventualidad, sus alcances y límites. ¿Pero, qué pasa cuando en medio de la suspensión contractual se presenta una inhabilidad sobreviniente por parte de alguno de los miembros de los consorciados? ¿La Administración puede aceptar la cesión de participación consorcial tal como lo establece la Ley en medio de la suspensión? El objetivo del presente artículo es resolver esta inquietud, tomando como base lo que ha dicho sobre el particular la doctrina y la jurisprudencia. El resultado es que la hipótesis presentada por los autores se confirma, concluyendo, que la Administración sí tiene la facultad para aceptar y tramitar la cesión de participación consorcial del ejecutor, cuando el contrato se encuentre suspendido |
