Desde que se tiene conocimiento, el derecho siempre se ha contextualizado desde el razonamiento humano, puesto que fue ese propio ser quien, bajo un análisis profundo, creó sistemas jurídicos para regular sus propios comportamientos. Con los avances tecnológicos el mundo se está planteando si debe reprogramar esa concepción tan longeva del derecho. El presente artículo pretende explicar esa transición que debe tener los postulados jurídicos de la titularidad de las obras intelectuales bajo el contexto de las nuevas tecnologías; mediante un análisis del impacto de la inteligencia artificial (I.A.) sobre los derechos de autor en Colombia, buscando plantear las bases para un constructo innovador que coloque la IA en un presupuesto más especializado donde se circunscriba bajo la hipótesis de un sujeto de derechos. Lo anterior, explicando de manera crítica los diferentes casos donde el derecho se ha quedado sin la capacidad de proteger ni regular diferentes situaciones donde se ven conculcados derechos principalmente de autor y derivados de este. |
