Lo anterior, debido a la influencia que han venido adquiriendo dentro del sistema financiero nacional y los diversos riesgos que pueden generar sin ningún tipo de control ni vigilancia, relacionados con: el crimen cibernético, el fraude financiero (como el lavado de activos), la financiación del terrorismo, la pérdida de recursos económicos y el impacto ambiental negativo. Esta investigación incluye un análisis comparado de regímenes regulatorios de criptomonedas en diez estados, con base en el concepto de regulación de Julia Black (2002) y de régimen regulatorio (establecimiento de normas, mecanismos para modificar el comportamiento y para la recopilación de la información) desarrollado por Lodge y Wegrich, (2012). Así mismo, explora las explicaciones sobre la ausencia y el posible surgimiento de regulación de criptomonedas en Colombia, a partir de las teorías de la regulación agrupadas por Baldwin, Cave y Lodge (2012). Con base en los resultados de ambos análisis, al final, se indican algunos elementos que convendría incluir en un marco regulatorio de las criptomonedas en Colombia.The aim of this research is to explore the need and orientation of a possible regulatory framework for the use and management of cryptocurrencies in Colombia. This is due to the influence they have been acquiring within the national financial system and the various risks they can generate without any control or oversight, related to: cybercrime, financial fraud (such as money laundering), terrorist financing, loss of economic resources and negative environmental impact. This research includes a comparative analysis of cryptocurrency regulatory regimes in ten states, based on Julia Black's (2002) concept of regulation and the regulatory regime (rule-setting, mechanisms for modifying behaviour and for information gathering) developed by Lodge and Wegrich, (2012). It also explores explanations for the absence and possible emergence of cryptocurrency regulation in Colombia, based on the theories of regulation grouped by Baldwin, Cave and Lodge (2012).
