It is intended to carry out an analysis, from the vulnerability and lack of protection of the victims of pedophilia and in a more tangential way on the inadequate treatment that is provided to the perpetrators. To do this, several perspectives are taken into account, especially the legal one. The phenomenon was studied through a qualitative method, where documents and observation were the data of interest. The information that was collected and served as support, was extracted from contexts where situations of pedophilia have been experienced. In Colombia, the problem of the sexual abuse of minors has taken on unexpected dimensions, making it necessary to rethink the criminal policy and all those policies that are related to the prevention of abuse; most statistics indicate that this is one of the most serious ways of damaging the physical, moral and psychological integrity of the victims. Pedophilia, considered a crime, punishable by penalties that does not comply with its fines and does not provide protection to minors; allows to make a reproach to the ineffectiveness and insufficiency of the norm and the criminal policy, in the face of this disorder, in a society where the real and effective protection of the rights of children has become a necessity. |

Para ello, se tienen en cuenta varias perspectivas, especialmente la jurídica. El fenómeno se estudió a través de un método cualitativo, donde los documentos y la observación fueron el dato de interés. La información –que se recolectó y sirvió de sustento– fue extraída de contextos donde se han experimentado situaciones de pedofilia. En Colombia, el problema del abuso sexual de menores ha tomado dimensiones inesperadas, siendo necesario replantear la política criminal, y todas aquellas políticas que resultan conexas para su prevención; la mayoría de estadísticas señalan que esta es una de las formas más graves de lesionar la integridad física, moral y psicológica de las víctimas. La pedofilia, considerada como delito, sancionada con penas que no cumplen con sus fines y no brindan protección a los menores de edad; permite realizar un reproche a la ineficacia e insuficiencia de la norma y la política criminal frente a este trastorno, en una sociedad donde la protección real y efectiva de los derechos de los niños se ha vuelto necesidad.É feita uma análise a partir da vulnerabilidade e desproteção das vítimas de pedofilia e mais tangencialmente sobre o tratamento inadequado dispensado aos agressores. Para isso, várias perspectivas são levadas em consideração, especialmente a jurídica. O fenômeno foi estudado através de um método qualitativo, onde os documentos e a observação foram os dados de interesse. As informações – que foram coletadas e serviram de suporte – foram extraídas de contextos onde foram vivenciadas situações de pedofilia. Na Colômbia, o problema do abuso sexual de menores assumiu dimensões inesperadas, tornando necessário repensar a política criminal e todas as políticas relacionadas à sua prevenção; A maioria das estatísticas indica que esta é uma das formas mais graves de ferir a integridade física, moral e psicológica das vítimas.
