description The purpose of this article is to make an approximation to the concept of social licensing; a figure that emerges from the multiple efforts of jurisprudence to agree on the economic interests of extractive companies and the collective fundamental rights of the inhabitants who reside in the jurisdiction of the municipality where a mining, oil or energy project is to be carried out.   The regulation of extractive projects has evolved towards the humanization of the normative content in order to harmonize the postulates of a market economy and the effective guarantee of the protected legal rights of the population. In this process and by mandate of jurisprudential pronouncements, a figure has been created that goes beyond the content of the special regulations and has been called: "Social license"; whose content has a relevant impact at the axiological and pragmatic level of law, since it is in itself to serve as a cornerstone in the new paradigm changes.   To understand this figure, the following methodological order will be addressed: i) initial approaches and constitutional development to the right of participation; ii) Social licensing as a tool for the effective application of the principles of coordination, concurrence and subsidiarity. iii) Reflections on popular consultations regarding ruling SU-095 of 2018. Finally, the bibliography that supports the statements in this article will be made available to the reader.

Finally, the bibliography that supports the statements in this article will be made available to the reader.El presente artículo tiene por objeto hacer una aproximación al concepto de licenciamiento social; figura que emerge de los múltiples esfuerzos de la jurisprudencia por concertar los intereses económicos de las empresas extractivas y, los derechos fundamentales colectivos de los pobladores que residen en jurisdicción del municipio en donde se pretende ejecutar un proyecto minero, petrolero o energético.   La regulación de los proyectos extractivos ha tenido una evolución tendiente a la humanización del contenido normativo, con el fin de armonizar los postulados de una economía de mercado y la garantía efectiva de los bienes jurídicos tutelados de la población. En dicho proceso y por mandato de pronunciamientos jurisprudenciales, se ha gestado una figura que desborda el contenido de las normas especiales y que se ha denominado como: “Licencia social”; cuyo contenido tiene un impacto relevante a nivel axiológico y pragmático del derecho, pues de suyo es el servir como una piedra angular en los nuevos cambios de paradigma.   Para el entendimiento de dicha figura se abordará el siguiente orden metodológico: i) Aproximaciones iniciales y desarrollo constitucional al derecho de participación; ii) El licenciamiento social como herramienta para la efectiva aplicación de los principios de coordinación, concurrencia y subsidiariedad. iii) Reflexiones sobre consultas populares en torno a la Sentencia SU-095 de 2018. Finalmente se dejará a disposición del lector la bibliografía que sustenta lo dicho en el presente artículo.O objetivo deste artigo é fazer uma aproximação ao conceito de licenciamento social; figura que emerge dos múltiplos esforços da jurisprudência para coordenar os interesses econômicos das empresas extrativistas e os direitos fundamentais coletivos dos habitantes que residem na jurisdição do município onde será executado um projeto de mineração, petróleo ou energia. A regulamentação dos projetos extrativistas teve uma evolução tendente à humanização do conteúdo normativo, de modo a harmonizar os postulados de uma economia de mercado e a efetiva garantia dos direitos jurídicos protegidos da população. Nesse processo e por mandato de pronunciamentos jurisprudenciais, desenvolveu-se uma figura que vai além do conteúdo das normas especiais e que foi denominada como: “licença social”; cujo conteúdo tem um impacto relevante ao nível axiológico e pragmático do direito, pois por si só deve servir de pedra angular nas mudanças de novo paradigma. Para a compreensão da referida figura, será abordada a seguinte ordem metodológica: i) Abordagens iniciais e desenvolvimento constitucional do direito de participação; ii) O licenciamento social como instrumento de aplicação efectiva dos princípios de coordenação, concorrência e subsidiariedade. iii) Reflexões sobre as consultas populares em torno do Acórdão SU-095 de 2018.
