This paper seeks to address the problem of the emergence of role of the police at Río de la Plata, as part of the consequences of enlightened thought at the end of theXVIII century. Special attention is given to the case of the city of San Miguel de Tucumán. The objective of this study is to highlight distinctive elements of the role of the police, as well as the way in which this role was understood by the people of the times: a new disciplinary ield related to establishing proper order and coexistence through a variety of functions and actions. Importance is given to the existing differences between police discourse and that of justice. While justice performed based on the judge’s jurisdictional power, the police, in charge of neighbors and families, justiied their existence through protection,safeguarding the public order based on domestic or economic power. Using the methodology of legal anthropology, an assumption is proposed: the role of the police emerged as a normative ield, closely related to economy, price control, and competition, fostering production and control over the poor. Hence, this study will analyze legal instruments and some of their main application ields. |

Hence, this study will analyze legal instruments and some of their main application ields.Este trabajo busca abordar el problema del surgimiento de la función de policía en el Río de la Plata como parte del pensamiento ilustrado de ines del siglo XVIII, con especial atención al caso de la ciudad de San Miguel de Tucumán. El objetivo es señalar algunos elementos deinitorios de esta función tal como era entendida por sus contemporáneos: como un nuevo terreno disciplinar relacionado con el buen orden y la buena convivencia, con una multiplicidad de funciones y acciones. Es de destacar la diferencia que existía entre el discurso de policía y el de justicia, ya que mientras la justicia actuaba a partir de la potestad jurisdiccional de los jueces, la función de policía a cargo de los vecinos y padres de familia justiicaba su existencia en clave tuitiva, tutelando el orden público sobre la base de una potestad doméstica o economica. Utilizando metodología de la antropología jurídica, se propone como hipótesis que la función de policía surgió como campo normativo en estrecha relación con la economía, en el control de los precios, de la competencia, el fomento a la producción y el control sobre los pobres. Para eso se analizarán sus instrumentos jurídicos y algunos de sus principales campos de aplicación.Ce travail aborde le surgissement de la fonction de police dans le Río de la Plata comme une partie de la pensée des Lumières à la in du XVIIIe siècle, avec une attention particulière au cas de la cité de San Miguel de Tucumán. Notre objectif est de signaler quelques éléments qui permettent de déinir cette fonction, tel qu’elle a été connue par ses contemporains: il s’agit d’un nouveau terrain lié au bon ordre et à la bonne coexistence, avec une multiplicité de fonctions et d’actions. Il faut souligner la différence existante entre le discours de police et celui de justice, puisque celle-ci agissait à partir du pouvoir juridictionnel des juges, alors que, à la charge des voisins et des parents de famille, l’existence de la fonction de police était justiiée dans une clé de protection [tuición], due à sa tutelle de l’ordre public sur la base d’un pouvoir domestique ou économique. En nous appuyant sur la méthodologie de l’anthropologie juridique, nous proposons l’hypothèse que la fonction de police a surgi en tant que champ normatif en relation étroite avec l’économie, ayant pour but le contrôledes prix et de la concurrence, ainsi que la promotion de la production et le contrôle sur des pauvres.
