In the first stage he sometimes expressed a passive consideration of tolerance and respect, to avoid violence, as a condition of the realization of the right. His correct understanding that the Spanish government would not grant Cubans and Puerto Ricans their claimed rights led him to conclude that only by the path of revolutionary violence could these be attained. Finally, he analyses his criteria for how the right should be exercised and cultivated in the long-awaited republican life.El trabajo analiza las ideas esenciales de José Martí acerca del derecho. Además valora sus criterios a partir de su acción revolucionaria y sus discursos, ensayos, etc., sobre los derechos humanos de determinados sectores sociales, entre ellos de los indígenas, los esclavos y los obreros, así como de los pueblos colonizados. Demuestra además de qué forma evolucionó su pensamiento en relación con los derechos humanos. Al respecto y en una primera etapa de su vida manifestó en ocasiones una pasiva consideración sobre la tolerancia y el respeto, para evitar la violencia, como condición de la realización del derecho. De igual forma su correcta comprensión de que el gobierno español no les concedería a los cubanos y puertorriqueños sus reclamados derechos lo llevó a la conclusión de que solo por la vía de la violencia revolucionaria estos podrían alcanzarse.
