En julio de 2021, una decisión del Tribunal Federal de Australia generó un importante interés internacional sobre una pregunta importante: ¿pueden las Inteligencias Artificiales (IA) aparecer como inventoras en las reclamaciones de protección de patentes de invenciones? La respuesta requiere de una valoración teórico-práctica basada en el proceso de definición de la actividad inventiva, qué son capaces de hacer las IA con un propósito específico e incluso con base en lo que dice la decisión en cuestión sobre la situación del caso. El trabajo practica este esfuerzo metodológico cuestionando lo que afirma la citada decisión sobre el estado del arte de las IA en términos de actividad inventiva. A través de la hipótesis de que no se plantea ningún postulado general de la IA y haciendo uso del método hipotético-deductivo, el trabajo confirma la hipótesis y concluye que la estructura argumentativa de ladecisión analizada es sólida, beneficiando incluso el contexto de innovación practicado a partir de la aplicación de la IA. técnicas. |

The answer requires a theoreticalpractical assessment based on the process of defining the inventive step, what specific purpose AIs are capable of doing and even based on what the decision in question states about the situation of the case. The work makes this methodological effort questioning what the aforementioned decision asserts about the state of the art of AIs in terms of inventive step.
