Summary: | The present investigation is aimed at establishing the conditions that must be met to establish the loss of parental authority. Authors define the loss of parental authority as the total misunderstanding of parental duties. This is where the importance of this investigation lies in establishing the causes of the problem, and the reason for the suspension of parental authority in which parents are more framed when exercising parental authority with respect to their children, find possible solutions to the true fulfillment of the filial parental regime of protection of the non-emancipated minor son. This work of degree presents a critical view from the academic and judicial doctrine responsible for interpreting the relationship between the regulatory institutions of the filioparentales relations of the Civil Code, namely, parental authority and parental authority. Evidence the evolutionary process of interpretation of these figures, to conclude with a call to the necessary interpretation tending to safeguard the rights of infants and the right of everyone to have a family. The central axis of the present investigation consists in carrying out a field work aimed at studying variable cases, brought before the administration of justice, in which the different causes of loss of parental authority contemplated in the civil order are alleged, and This way, we can extract possible conclusions from the main causes that have been affecting the family path in the face of these repeated social circumstances as well as the defense mechanisms to exercise the rights that this legal figure gives rise to. Another important factor is the figures that rest in the family courts in the City of Barranquilla; in the years 2015 and 2016, that will help us to better understand this topic. |
