A partir del estudio de sentencias proferidas por tribunales nacionales e internacionales, se establecen cuatro posibles tipos de intervención de los jueces en este campo. Por último, se analiza la intervención judicial para garantizar la participación de grupos y movimientos sociales en el diseño y toma de decisiones relacionadas con dichas políticas. This article seeks to identify types of situations in which judicial power has taken on the task of verifying legal standards in the design and development of public policies in regard to the guarantee of social, economic and cultural rights as well as civil and political rights. Based on the study of national and international precedents, this paper establishes four types of judicial decisions in this matter.
